In a significant step towards inclusivity, the Finance Ministry has clarified that members of the LGBTQ+ community face no restrictions in opening joint bank accounts or nominating their partners as beneficiaries. This announcement, made on Wednesday, directly addresses concerns raised following the Supreme Court’s order on the legal recognition of same-sex marriages in October 2023.

The Supreme Court, while declining to legalize same-sex marriage, emphasized the imperative for both the Union and state governments to ensure that LGBTQ+ individuals are not subjected to discrimination due to their sexual orientation or gender identity. The Department of Financial Services, echoing this sentiment in a public advisory, explicitly stated that 'there are no restrictions for persons of the queer community to open a joint bank account and also to nominate a person in the queer relationship as a nominee to receive the balance in the account, in the event of death of the account holder.'

This clarification builds upon previous efforts to address financial inclusion for the LGBTQ+ community. In 2015, following a landmark Supreme Court judgment recognizing transgender individuals as a third gender, several banks introduced services specifically tailored to their needs. The Reserve Bank of India (RBI), on August 21, further reinforced these directives by issuing a clarification to banks, urging them to adhere to the guidelines ensuring equal financial access for all individuals, regardless of their sexual orientation or gender identity.

This recent statement from the Finance Ministry reinforces the government’s commitment to creating a more inclusive and equitable society for LGBTQ+ individuals. The government’s formation of a six-member committee in April, led by the cabinet secretary, specifically to address the issues faced by the queer community, underscores this commitment. This committee aims to ensure equal access to services for LGBTQ+ individuals and to safeguard them from discrimination, coercion, and harassment.

The Finance Ministry’s clarification on joint bank accounts and nominations signifies a tangible step towards financial inclusion for LGBTQ+ individuals, empowering them to manage their finances with the same rights and access as all other citizens.
