Supreme Court Dismisses Review Petitions on Article 370 Verdict

The Supreme Court of India has dismissed the petitions seeking review of its earlier judgment upholding the abrogation of the special status of Jammu and Kashmir under Article 370 of the Constitution.

A 5-judge bench led by Chief Justice of India DY Chandrachud examined the review petitions and concluded that there was no apparent error in the original judgment delivered on December 11, 2023.

The bench noted that the review petitions did not present any new or substantial grounds to warrant a review of the earlier decision.

In its earlier judgment, the Supreme Court had upheld the Presidential Orders that revoked the special status of Jammu and Kashmir.

However, the court had refrained from adjudicating the constitutionality of the Jammu and Kashmir Reorganisation Act, which divided the state into two Union Territories.

The court had also set a deadline of September 30, 2024 for the holding of elections to the legislative assembly of Jammu and Kashmir.

The Supreme Court's decision to dismiss the review petitions effectively brings to a close the legal challenges to the abrogation of Article 370.

The decision is a significant victory for the government, which had argued that the abrogation of Article 370 was necessary to fully integrate Jammu and Kashmir into the Indian Union.

The decision is also likely to have a significant impact on the future of Jammu and Kashmir, which has been under direct central rule since the abrogation of Article 370.
